General Scope
These Terms and Conditions (“Terms”) govern the purchase and use of IT services provided by “Antreprenor Independent Cornel-Florentin Dimitriu” (“Company,” “we,” “us,” or “our”) through our website motionlibre.org/shop.
By placing an order or making a payment on this website, you (“Client” or “User”) agree to be bound by these Terms.

Services may be provided remotely, or on-site.
Order Process and Service Agreement
A service agreement is formed when:
- a customer places an order; or
- a written or electronic confirmation is provided; or
- service delivery begins with customer consent.
No work is performed without authorization.
By requesting a service, the customer agrees that:
- they are authorized to request services for the device or system;
- they understand the scope of work requested;
- services may require additional work based on diagnostics results.
Work only begins after customer approval (written, electronic, or verbal where applicable).
Pricing, Currencies, and Payment
- Pricing & Taxes: All prices are displayed on our website in [MDL / EUR]. Prices include applicable Moldovan VAT where required. Prices may be: fixed (for defined services), as hourly rate (for consultancy and support), or estimate-based (for diagnostics and complex tasks). Customers are informed of any additional costs before proceeding.
- Extra fees: In some special cases (for example, for on-site support, or for emergency or night-support) travel or emergency fees might be added to the total cost, and this will be agreed upon before proceeding.
- Accepted Payment Methods: Secure payments via card networks (Visa and Mastercard), or bank transfers
- Payment Security: Credit/debit card transactions are processed via secure payment gateways utilizing 3D Secure protocol. We do not store or capture full credit card details on our servers.
- Invoicing: Electronic invoices will be issued to the email address provided during checkout.
Service Delivery and Shipping
Services may be delivered:
- remotely;
- by the means of courier
- on-site;
- digitally (consultancy or support sessions).

Delivery times are estimates and may vary depending on:
- technical complexity;
- availability of additional tools or parts needed;
- customer responsiveness;
- external conditions
We aim to complete services within a reasonable timeframe.
Customer Responsibilities
Customers agree to:
- provide accurate and complete information;
- ensure legal ownership or authorization for the device/system;
- back up important data before service;
- cooperate during service delivery;
- use authorized software only.
Customers are responsible for maintaining backups of their data.
For event services, the client is responsible for:
- venue suitability
- power supply and infrastructure
- access permissions
- providing clear and accurate technical requirements
Data Access and Confidentiality
During service delivery, we may access customer systems only as necessary to perform requested work.
We:
- limit access to service-related data only;
- treat all customer information as confidential;
- do not intentionally access unrelated personal files;
- restrict access to authorized personnel only.
By requesting remote support, the customer authorizes temporary remote access to their device for the purpose of diagnostics and technical assistance.
Customers may terminate remote sessions at any time.
Prohibited Use and Service Refusal
Customers agree not to use our services in any manner that violates applicable laws or regulations of Moldova, the European Union, or other relevant jurisdictions.
We reserve the right to refuse or terminate services involving unauthorized software usage, abusive conduct, unsafe conditions, or suspected unlawful activity.
In addition, we reserve the right, at our sole discretion, to refuse service requests that may expose us to legal, regulatory, reputational, or security risks.
Customers may not use our services, systems, infrastructure, software, remote support, consultancy, or technical assistance for any unlawful, fraudulent, or prohibited purpose.
We strictly prohibit the use of our services in connection with:
- money laundering;
- terrorism or terrorist financing;
- fraud or financial scams;
- unauthorized system access;
- unauthorized licenses;
- identity theft;
- illegal content;
- malware distribution;
- phishing or cybercrime activities;
- operation of illegal businesses or services;
- violation of applicable laws or sanctions.
We reserve the right to refuse or terminate service where:
- safety concerns exist;
- unlawful activity is suspected;
- customer behavior is abusive or non-cooperative;
- technical limitations prevent service delivery.
We reserve the right to:
- refuse or terminate services;
- suspend accounts or access;
- report suspected unlawful activities to competent authorities.
Customers are solely responsible for ensuring that their use of our services complies with all applicable local, national, and international laws and regulations.
While visiting our website, users agree not to:
- misuse the website;
- attempt unauthorized access;
- interfere with website operation;
- upload malicious content.
Refunds, Cancellations and Complaints
Refunds are governed by our Refund and Returns Policy.
In general:
- completed services are non-refundable, unless the service is not complete, or the result is different than the scope of the service agreement, as a result of out fault;
- diagnostics and consultancy services already delivered are non-refundable;
- cancellations may be possible before service commencement;
- otherwise, cancellations may incur fees for work already performed.
If delivered software/services fail to meet agreed technical specifications, we will remediate the issue within 14 days. If remediation fails, a partial or full refund may be granted.
Customers are encouraged to contact us directly to resolve any issues before initiating payment disputes.

We aim to resolve disputes fairly and promptly.
Refund requests are assessed individually in accordance with applicable consumer protection laws.
Where a chargeback is filed, we may provide supporting evidence to the payment provider, including:
- service records;
- communication history;
- proof of service delivery.
EU Consumer Right of Withdrawal Notice
If you are a consumer residing in the European Union purchasing digital services:
- Under EU distance selling regulations, you generally have a 14-day right of withdrawal without giving a reason.
- Waiver for Immediate Performance: By purchasing our services and requesting immediate performance/execution of digital work before the expiration of the 14-day withdrawal period, you explicitly request that performance begin immediately and acknowledge that you lose your right of withdrawal once the service has been fully performed.
Technical Limitations
Due to the nature of technical systems:
- we do not guarantee that all issues can be resolved;
- some systems may be irreparable or economically unviable to repair;
- software/hardware compatibility issues may limit outcomes.
Services are performed with reasonable professional skill and care, but we cannot guarantee:
- full recovery of all systems
- permanent virus/malware removal
- compatibility of all software/hardware combinations
- recovery of damaged or corrupted data
Remote support sessions may be interrupted due to:
- internet connectivity issues;
- software restrictions;
- security settings;
- hardware faults.
For electronics development and consultancy:
We do not guarantee that all designs or concepts are:
- commercially viable
- technically feasible under all conditions
- manufacturable within all budgets
Prototypes and experimental systems may vary in performance due to:
- component variation
- environmental conditions
- manufacturing tolerances
For audio/video/events:
Event services depend on environmental and venue conditions.
We do not guarantee:
- uninterrupted performance
- optimal acoustics or lighting outcomes
- third-party system compatibility
Equipment performance may be affected by:
- venue conditions
- external interference
- audience/environment factors
Data Loss Disclaimer
While reasonable care is taken during diagnostics, repair, installation, and maintenance services, we do not guarantee preservation of customer data.
We shall not be liable for:
- data loss;
- corruption of files;
- software failures;
- operating system reinstallation consequences;
- recovery failure.
Customers are strongly advised to maintain independent backups before any service is performed.
Customers can also ask us separately for a backup service. This is not performed by default, nor included in any other service by default.
Service Scope, Compatibility & Functional Limitations
All services are provided strictly in accordance with the description presented at the time of purchase and agreed scope of work.
The Customer acknowledges and agrees that it is their responsibility to review the service description carefully before placing an order, and to ensure that the requested service meets their expectations and requirements.
We shall not be held responsible for any dissatisfaction, disputes, or claims arising from:
- the Customer’s failure to review or understand the service description prior to purchase;
- missing features, limitations, or bugs in existing or installed software, hardware, or firmware;
- compatibility issues between systems, devices, or third-party components;
- functionality differences compared to manufacturer, developer, or vendor specifications;
- any reduction, modification, or removal of features resulting from installation, configuration, or customization work performed at the Customer’s request.
Where custom operating systems, software, firmware, drivers, or configurations are installed or modified at the Customer’s request, the Customer acknowledges that such modifications may:
- alter or disable certain manufacturer-provided features;
- reduce or replace original functionality;
- affect performance, stability, or compatibility with third-party software or hardware.
Such outcomes are considered inherent risks of customization and are not deemed defects or service faults.
It is the Customer’s responsibility to ensure they have obtained and reviewed relevant information regarding the original features, limitations, and specifications of any hardware or software prior to ordering.
By proceeding with the service, the Customer confirms that they accept these potential limitations and outcomes as part of the requested work.
Customer-Supplied Parts & Materials
Where services require hardware components, replacement parts, or other materials, the Customer acknowledges and agrees that it is their responsibility to provide and ship all necessary parts to us in advance of service delivery, unless otherwise explicitly agreed in writing.
We do not sell, supply, source, or resell hardware parts or replacement components. Our services are limited strictly to installation, diagnostics, configuration, repair, or consultancy work performed using customer-provided or pre-agreed materials.
We are not responsible for:
- delays caused by missing, incorrect, or incompatible parts provided by the Customer;
- inability to complete services due to insufficient or faulty supplied components;
- performance issues arising from customer-provided hardware or materials;
- compatibility or warranty issues related to third-party or customer-supplied parts.
The Customer is solely responsible for ensuring that all provided parts are correct, compatible with their system, and suitable for the intended service prior to shipment.
Warranty on Services
Unless otherwise stated, repairs are covered by a limited warranty of 90 days from completion date, and services are covered by a limited warranty of 15 days from completion date.
Warranty for the repairs omly cover the scope of the repair, and does not cover:
- accidental damage;
- liquid damage;
- misuse or negligence;
- power surges;
- malware or virus infections after service;
- unauthorized modifications or repairs by third parties;
- normal wear and tear.
Warranty for the services covers only that the services was performed accordingly to the description.
Warranty claims may require inspection before approval.

Intellectual Property Rights
Upon full payment of all outstanding invoices, the Client receives the ownership or license rights to the custom deliverables specified in the contract. “Antreprenor Independent Cornel-Florentin Dimitriu” retains rights to all pre-existing tools, open-source components, and core intellectual property used to build the deliverable.
Limitation of Liability
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, business interruption, or consequential damages;
- our liability is limited to the amount paid for the relevant service;
- we are not responsible for data loss
Nothing in these Terms excludes liability that cannot legally be excluded.
Force Majeure
We are not liable for failures caused by:
- power outages
- communication network issues
- weather conditions
- government restrictions
- emergencies
Privacy and Data Protection
We collect and process personal data in accordance with Moldovan Law No. 195/2024 on Personal Data Protection and the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) where applicable.

Governing Law
These Terms are governed by the laws of the Republic of Moldova, and applicable European Union legislation, unless otherwise required by mandatory consumer protection laws in the customer’s country of residence.
Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be settled through amicable negotiations. If an agreement cannot be reached, the dispute shall be submitted to the competent courts of the Republic of Moldova.
Changes to Terms
We may update these Terms from time to time.
Updated versions will be published on our website with a revised effective date.
